How New Zealand regulates supplements

Dietary supplements in New Zealand are governed principally by the Dietary Supplements Regulations 1985, made under the Food Act and administered with Medsafe involvement where a product edges toward being a medicine.

Those regulations are old, and they are widely acknowledged to be so. They set compositional and labelling requirements but do not involve pre-market assessment of the kind Australia’s TGA carries out. Successive governments have attempted to replace them — the proposed trans-Tasman joint agency, and later the Therapeutic Products Act — and the replacement regime has had a long and unsettled history.

What has been stable is the medicine boundary: a product presented as treating or preventing a condition is a medicine and requires consent under the Medicines Act. That is the line supplements stay clear of, which is why labels here describe the formula and how it is used rather than promise an outcome — the same convention British labels follow.

Food composition and labelling standards are shared with Australia through FSANZ, so the two countries have common ground on food while differing markedly on therapeutic goods.

What that means for ordering from overseas
